The 2026 NSW Land Tax Loophole Every Property Investor Should Know

The 2026 revision to NSW land tax thresholds has introduced a significant, though time-limited, opportunity for property investors holding two or more investment properties in New South Wales.

What Changed

Effective 1 January 2026, the NSW Government adjusted the land tax threshold from $969,000 to $1,075,000 for general taxpayers. While this sounds straightforward, the interaction between the new threshold and existing trust structures has created a planning window that experienced investors should act on before the end of the financial year.

The Opportunity

If you hold investment properties through a discretionary (family) trust, the new threshold applies independently to each trust structure. This means investors with properties across multiple trusts may see their combined land tax liability reduce — or disappear entirely — if each trust's total land value sits below the new threshold.

What You Should Do Now

1. Review your current land valuations. The Valuer General's determinations from 1 July 2025 are the figures used for the 2026 tax year. If your total holdings are close to the threshold, restructuring may be worthwhile.

2. Speak with your accountant and broker. Refinancing a property from personal ownership into a trust requires a new loan — and not all lenders treat trust borrowing the same way. We work with a select group of lenders who specialise in trust lending and can guide you through the credit implications.

3. Act before June 30. The current threshold is under review and may not be adjusted upward again in 2027. The window of opportunity is finite.

The Bottom Line

Tax planning and lending strategy should always work together. At Sovereign Lending, we coordinate with your accountant to ensure any structural changes are supported by the right loan products. If you're considering a restructure, start the conversation early — lender credit timelines can take 4–6 weeks.
